Cognos Terms of Service
Introduction
Welcome to Cognos, a privacy-focused generative AI platform operated as a Sole Proprietorship by Ewan Jones, located in Luzern, Switzerland. By using our services, you agree to these Terms of Service (Terms), which govern your use of the Cognos platform, including any input in text, video, audio, or images you provide and the AI-generated content you receive.
Use of Service
- Eligibility: You must be at least 16 years old to use Cognos, and at least 18 to use any not-safe-for-work (NSFW) models provided by the platform.
- Prohibited Use: The Cognos platform must not be used for illegal activities, including piracy, distribution of child sexual abuse material, or hacking. Users found engaging in such activities will have their access immediately cancelled.
- Intellectual Property: Users retain rights to their input data but cannot claim intellectual property rights or ownership over data generated by AI services.
User Responsibilities
- Security and Exploitation: Attempts to exploit the system or circumvent security measures are strictly prohibited.
- Service Access: Cognos reserves the right to rate limit or restrict access at its discretion.
- Subscription Termination: Users can terminate their subscription at any time, with access ending after the current subscription period. Cognos may also terminate a users subscription at any time and at their own discretion.
- Non-payment: Access will be revoked in case of non-payment, but users will retain access to their data.
Data Management
- Data Storage: User inputs and AI-generated data are stored encrypted. Cognos maintains some plaintext data for internal reporting but does not access the content of messages or AI-generated content.
- Data Deletion: Accounts with no login activity for six months will have their user data deleted.
- Inappropriate Content: Users can report inappropriate content, granting Cognos staff access to review and potentially remove such content.
Legal
- Governing Law: These Terms are governed by Swiss law, with jurisdiction in Luzern, Switzerland.
- Liabilities and Warranties: Cognos accepts no liabilities and offers no warranties for the services provided.
- Dispute Resolution: All disputes will be subject to the exclusive jurisdiction of the courts located in Luzern, Switzerland.
Changes to Terms
- Cognos reserves the right to modify these Terms at any time. Registered users will be notified of changes via email.
Acceptance of Terms
By using Cognos, you acknowledge that you have read, understood, and agreed to these Terms of Service. Your continued use of the service after any changes indicates your acceptance of the new Terms.
